Terms of Service

Last updated: 28 October 2026

1. The service

Passeur provides real-time translation of phone calls and, optionally, AI-assisted outbound calls made on your behalf. The service is published by David Marques, sole proprietor (see the legal notice). By creating an account you agree to these terms.

2. Acceptable use

You agree to use Passeur only for lawful, person-to-person communication. You must not use it for:

  • unsolicited marketing, robocalling, or bulk calling of any kind;
  • harassment, threats, fraud, or impersonation;
  • calling emergency services (Passeur is not suitable for emergency calls);
  • recording or translating calls without informing the other parties, where the law requires their knowledge or consent;
  • any activity that violates telecommunications regulations in your country or the called party’s country;
  • cloning any voice other than your own (Business plan) — grounds for immediate termination.

We may suspend or terminate accounts that breach these rules.

3. Your responsibilities

You are the initiator of every call placed through your account and are responsible for its content and legality, including obtaining any consent required from call participants. Keep your credentials and API keys secure; activity under your account is your responsibility.

4. Plans, billing, and minutes

The free plan includes 30 minutes of translated calls to try, once: this allowance does not renew monthly. Paid plans (Starter, Pro, Business) are billed monthly through Stripe; their minute allowance is refilled at each paid renewal and includes the minutes and features stated on the pricing page at the time of purchase. Unused minutes do not roll over. Prices are in euros, including taxes (VAT not applicable, art. 293 B of the French Tax Code). You can cancel any time via the billing portal; your plan stays active until the end of the paid period.

5. Right of withdrawal

If you are a consumer, you have 14 days from subscribing to a paid plan to withdraw, without giving a reason, by emailing hello@passeur.app (you may use the model below; it is optional). We then refund the full amount paid, within 14 days of your request, using the payment method you used (French Consumer Code, art. L221-18 and L221-24).

Model withdrawal form: “To Passeur (David Dias Marques, EI), 29 rue Tronchet, 75008 Paris, France (hello@passeur.app): I hereby give notice that I withdraw from my contract for the following subscription: [plan], subscribed on [date]. Name of consumer: [name]. Address of consumer: [address]. Account email: [email]. Signature of consumer (only if this form is notified on paper): [signature]. Date: [date].”

6. Translation accuracy

Machine translation is imperfect. Passeur is provided for convenience and general understanding — do not rely on it where a mistranslation could cause harm (legal proceedings, medical instructions, financial commitments). For those, use a professional interpreter.

7. Availability and liability

The service is provided without warranty of uninterrupted availability. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the three months preceding the claim. Nothing in these terms limits liability that cannot be limited by law, or your consumer rights (including the legal guarantee of conformity).

8. Data

Our handling of your data, including call audio, transcripts, and recordings, is described in the Privacy Policy.

9. Complaints and mediation

For any complaint, email hello@passeur.app first. If you are a consumer and the dispute is not resolved, you may refer it free of charge to our consumer mediator: CM2C (Centre de la médiation de la consommation de conciliateurs de justice), 49 rue de Ponthieu, 75008 Paris, www.cm2c.net, or by email to declarer-un-litige@cm2c.net.

10. Governing law

These terms are governed by French law. If you are a consumer, you may bring proceedings in the courts of your place of residence and keep the protection of the mandatory rules of your country of residence.

11. Changes and contact

We may update these terms; material changes will be announced by email. Continued use after changes take effect constitutes acceptance. Questions: hello@passeur.app.
